O-1 Visa Overview
The O-1 visa is a nonimmigrant visa for individuals with extraordinary ability in the arts, sciences, education, business or athletics.
O-1A: Individuals with an extraordinary ability in the sciences, education, business, or athletics (not including the arts, motion pictures or television industry).
O-1B: Individuals with an extraordinary ability in the arts or extraordinary achievement in motion picture or television industry.
O-2: Individuals who will accompany an O-1 artist or athlete to assist in a specific event or performance.
O-3: Individuals who are the spouse or children of O-1 and O-2 visa holders.
Requirements of O-1 Visa
To qualify for an O-1 visa, the applicant must provide evidence of a one-time internationally-recognized award such as a Nobel, Pulitzer, Oscar, or Olympic Medal, or at least 3 of the criteria below:
- Evidence of receipt of lesser nationally or internationally recognized prizes or awards for excellence in the field.
- Membership in associations in the field that require outstanding achievements, as judged by recognized national or international experts.
- Published material about the applicant in professional or major trade publications or other major media.
- Evidence of participation as a judge of the work of others in the field, either individually or on a panel.
- Original scientific, scholarly, artistic, athletic, or business-related contributions of major significance to the field.
- Authorship of scholarly articles in professional or major trade publications or other major media.
- Evidence of the display of the applicant’s work in the field at artistic exhibitions or showcases.
- Performance in a leading/starring or critical role in productions/events or organizations/establishments that have a distinguished reputation.
- Evidence that the applicant commands a high salary or other significantly high remuneration in relation to others in the field.
- Evidence of commercial successes in the performing arts, as shown by box office receipts or sales records.
Key Features for O-1 Visa
- Immigration Status: Temporary, non-immigrant status. O-1 visa holder may have quasi “dual intent” to work in the U.S. in O-1 status for a temporary period, and also, apply for a green card to remain longer in the U.S. However, there may be additional timing considerations.
- Period of Validity: O-1 visa holders are authorized to stay and work in the U.S. initially for a 3-year period with 1-year extensions possible as long as the O-1 applicant continues his/her extraordinary activities.
- Work Authorization for Applicant Spouse: An O-3 spouse is not eligible for work authorization in the U.S.
